A state appeals court has dismissed a $250 million lawsuit against Ivanka Trump by New York Attorney General Letitia James. The lawsuit alleged business fraud during Ivanka Trump’s tenure at the Trump Organization.
The panel, consisting of five appellate judges, determined that the claims Attorney General James had set forth against the former president’s daughter fell beyond the state’s statute of limitations. The panel further ruled that the newer accusations of impropriety occurred after Ivanka Trump had transitioned from the family business to a position within her father’s White House administration.
The court ruling clarified that the allegations levied against Ivanka Trump did not support any claims post-February 6, 2016 and, therefore, should have been dismissed. The court further clarified that Attorney General James could not pursue claims that appeared before July 13, 2014, or after February 6, 2016, depending on the defendant.
Initiated in September 2022, the lawsuit called out the Trump Organization, former President Donald Trump, and three of his children: Ivanka, Donald Jr, and Eric as defendants. James’ suit claimed that they had misled banks, insurance companies, and others about the value of Trump’s assets, including golf courses and Mar-a-Lago. The Attorney General sought $250 million in damages and a prohibition on the Trump family doing business in New York.
Though the lawsuit will move forward against the other defendants, the court suggested that the case could be further constrained. A spokesperson for the Trump family applauded the court’s decision as the first step towards quashing a case that they believe should never have been lodged, adding that the appropriate enforcement of the law would limit the Attorney General’s previously unlimited reach.
James’ office countered by asserting substantial evidence of fraudulent valuation and misrepresentation of assets by Trump and the Trump Organization.
