Trump’s and His Lawyer’s Shocking Comments to Judge

In an Atlanta, Georgia courtroom, the contentious issue of constitutional speech protections took a new twist during a hearing involving former President Donald Trump’s legal team. They made the bold assertion that even lies are protected under the First Amendment. This claim was part of their strategy to have charges against Trump dismissed, charges that pertain to his alleged interference in Georgia’s 2020 election results.

The March 28, 2024 hearing was primarily focused on Trump’s constant allegations of election fraud, especially those directed at Georgia Secretary of State Brad Raffensperger. Led by Steve Sadow, Trump’s defense team argued that the former president’s actions were the pinnacle of political speech, and therefore, fundamentally safeguarded by the First Amendment.

The defense team sought to counter charges that Trump had made false statements. They pointed to events such as the infamous January 2, 2021, phone call with Raffensperger where Trump falsely claimed to have won Georgia by a substantial margin, alleged that nearly 5,000 deceased individuals had voted, and wrongfully branded a poll worker as a criminal without any substantiating evidence.

However, the prosecution, led by Fulton DA’s chief senior district attorney Donald Wakeford, countered this defense vigorously. Wakeford underscored the real-world negative impact of Trump’s actions on government operations, drawing a line between protected speech and criminal conduct. The prosecution’s narrative was clear: Trump’s false statements were not simply opinions, but actions that gravely harmed the integrity of the electoral process and amounted to criminal activity with explicit intentions.

The prosecution’s argument was further strengthened by renowned Racketeer Influenced and Corrupt Organizations (RICO) law expert John E. Floyd. Floyd’s involvement underscored the seriousness of the charges, positioning Trump’s actions within the context of a criminal conspiracy that goes beyond the limits of protected free speech.
