CNN Launches Historical Lawsuit Against Department of Justice

In a move that’s unprecedented in contemporary American politics, CNN has initiated a legal fight to gain public access to the audio recordings of an interview between President Joe Biden and federal investigators. Ex-Special Counsel Robert Hur conducted the interview, and it probed Biden’s management of classified documents following his term as vice president.

At the core of the dispute is a five-hour interview between President Biden and Hur, a rare instance in which a sitting president has been under potential scrutiny for charges by a prosecutor. The interview was a part of Hur’s comprehensive investigation, which ended without enough evidence to indict Biden for criminal mishandling of documents. After the investigation concluded, the Justice Department released transcripts of the interview but kept the audio recordings under wraps, igniting a debate on the extent of public records.

Filed in the DC District Court, CNN’s legal challenge aims to force the Department of Justice to disclose these audio recordings, asserting that “Transcripts, however, are no substitute for recordings.” This move by the news outlet emphasizes a broader push for transparency, enabling the public and journalists to make their own judgments about Hur’s conclusions and the portrayal of Biden as a “sympathetic, well-meaning, elderly man with a poor memory.”

However, the dispute is not limited to CNN. Several other news outlets, as well as organizations like the conservative Heritage Foundation and Judicial Watch, have also sought access to the recordings. These combined efforts underscore a rising demand for governmental transparency and the public’s responsibility to hold leaders accountable.

Throughout his investigation and subsequent comments at a congressional hearing, Hur stressed the importance of the recordings in his decision-making process. According to Hur, the audio provides crucial insights into Biden’s demeanor and mental processes, aspects that transcripts alone can’t fully capture. This point strengthens the argument for releasing the recordings, implying they contain critical evidence that could influence public perception of the investigation’s results.

The Biden administration, on the other hand, has contested Hur’s depiction of the president, disagreeing with the characterization of Biden’s memory and cognitive capabilities. In the publicly released transcripts, Biden appeared to show instances of confusion about dates and specifics, including the years of his vice presidency and the passing of his son, Beau Biden, which Biden denies.

Alongside CNN’s lawsuit, House Republicans have increased their calls for transparency. The Chairmen of the House Judiciary Committee, Jim Jordan of Ohio, and the Oversight Committee, James Comer of Kentucky, outlined their strong position in a letter sent on March 25 to Attorney General Merrick Garland.

In their letter, they warned that the Justice Department might face contempt proceedings if it fails to provide subpoenaed materials from Hur’s investigation. They specifically mentioned the lack of audio recordings from Hur’s interviews with President Biden and both the transcript and audio recordings from Hur’s conversations with Mark Zwonitzer, Biden’s ghostwriter, as instances of the information being withheld.

The Chairmen’s letter to Attorney General Garland underscored that the subpoenas issued on February 27 legally obligate the Attorney General to furnish the requested materials. They set a deadline of noon on April 8, for full compliance. The deadline was not met. It remains to be seen how Congress will react.

As legal challenges from CNN and others progress, they bring issues of privacy, public interest, and the right to information to the forefront. They prompt questions about balancing the protection of sensitive information with ensuring that voters are fully informed about their leaders’ actions and character.

Moreover, the legal pursuit highlights the distinct nature of Biden’s interview, a seldom-seen situation where a sitting president has been directly involved in a prosecutorial scrutiny of his conduct. This starkly contrasts with ex-President Donald Trump, who was subject to multiple investigations but never participated in such an interview.
